Ohio Governor Signs Bill Restricting Bathroom Access for Transgender Students

Ohio Governor Mike DeWine has signed a new law that bans transgender students in public and private schools from using multiperson bathrooms corresponding to their gender identity. The law applies to students from kindergarten through college and will take effect in 90 days.

The signing occurred quietly on Tuesday, despite opposition from Democrats, teachers’ unions, and civil rights groups. These groups had hoped DeWine would veto the measure, especially after he rejected a ban on gender-affirming care for minors last year. However, the governor issued no statement regarding the law.

The law, known as the “Protect All Students Act,” mandates that schools designate separate bathrooms, locker rooms, and overnight accommodations for males and females based on sex assigned at birth. While it lacks an enforcement mechanism, the law exempts certain groups like school employees and individuals assisting children or people with disabilities.

Supporters of the law, such as state Sen. Jerry Cirino, argue that it prioritizes safety and security for students in private spaces. Meanwhile, critics like the ACLU of Ohio contend that it infringes on the privacy rights of LGBTQ+ individuals, especially transgender youth, and could lead to increased harassment.

The bill adds to a growing national trend where Republican-led states have passed laws restricting transgender rights. In addition to bathroom bans, several states have implemented policies limiting access to gender-affirming care or participation in sports.
